Victoria A-6 Miravalle Cusco, in its capacity as a Travel and Tourism Agency, hereinafter “THE AGENCY”, is committed to the privacy and well-being of its clients; for such reasons and in compliance with the provisions of Peruvian Law No. 29733 – “Personal Data Protection Law” and its Regulations – Supreme Decree No. 003-2013 JUS, and in Supreme Decree No. 005-2020-MINCETUR (“The Regulations”), as well as its complementary, modifying and/or any other regulations, has adopted the necessary confidentiality and security measures so that the information provided to us and/or to which we have access, is suitably and permanently protected, as follows:
CONDITIONS OF PURCHASE
ANDESCAPE PERU S.A.C., in its capacity as a Travel and Tourism Agency, suggests the careful reading of the TERMS AND CONDITIONS that appear at https://www.andescapeperu.com (hereinafter the “Website”) since the use of its “Website” is conditioned to the acceptance of these TERMS AND CONDITIONS. By using the “Website”, the User expresses their acceptance of the TERMS AND CONDITIONS, which may eventually be modified, being that any modification will be effective immediately upon implementation and never retroactively.
By browsing this website, you consent to its terms of use. If you do not agree with them, you are not authorized to continue browsing this website and must immediately leave the site.
DEFINITIONS

“User”: Any person of Peruvian or foreign nationality who travels temporarily and uses the ANDESCAPE PERU S.A.C. “Website” in order to contract the tourist services provided by “THE AGENCY” through it.

“Provider”: A legal entity or natural person that directly provides the tourist services to the “User”, contracted, reserved, or acquired by them through the ANDESCAPE PERU S.A.C. “Website”.
EXPRESS DECLARATION AND USER RESPONSIBILITY
By accepting these TERMS AND CONDITIONS, the “User” expressly declares the following:

To be of legal age and have full legal capacity to enter into contracts.

That they will use the “Website” to acquire tourist services.

That they will be attentive to the information that ANDESCAPE PERU S.A.C. sends to the email address provided for this purpose, as it will be assumed that they took timely knowledge of the confirmation of their reservation or any inconvenience or variation thereof, with the sending of said information to the email address provided to “THE AGENCY”.

That they are informed of the conditions required in each selected tourist destination or in transit countries, having verified, well in advance, the conditions of entry to said country or selected final destination, conditions regarding requirements for driver’s licenses, vaccinations, permits for the entry of minors and/or departure of minors from Peru. Likewise, that they are fully aware that travel requirements may vary depending on the selected destination.

That they declare that all the information provided is real, accurate, current, and complete.

ANDESCAPE PERU S.A.C. will take as true and valid information that which is entered by the “User” at the time of making their reservation, considering that they have correctly entered their data (names and surnames) as they appear on their valid and current identity document (ID/DNI/Passport or Alien Registration Card). Once the service(s) is(are) reserved and/or paid for, it will not be possible to correct and/or modify them.

Rates are expressed in United States Dollars (USD), with the current exchange rate in Soles, and are subject to availability and/or while supplies last.

These conditions apply to the itinerary and travel dates according to what is requested and designated by the “User”.

It is the obligation of the “User” to correctly fill in the data, select dates, destinations, and other specifications for the acquisition of the service, leaving ANDESCAPE PERU S.A.C. exempt from all responsibility, since the data is provided and filled in by the “User”.

It is an essential requirement that the “User” is of legal age to acquire our services through the “Website”.
ANDESCAPE PERU S.A.C. declares the following:

That it is a Peruvian company, incorporated under the laws of Peru.

That it has all the sectorial permits to market the tourist services offered.

That it is dedicated to acting as an intermediary between the providers of tourist services of different kinds and the users, through its “Website”, providing declaratively, but not limited to, the service of land and air transportation reservations; reservation of hotels and lodging establishments; reservation of tourist attraction sites; reservation of travel packages, among others. As a consequence, once the reservations are confirmed to the “User” through the “Website”, and the content of the chosen tourist services is satisfactory to them, the intermediation service will be concluded, since said tourist services will be provided directly by the “Provider(s)”.
USE OF THE WEBSITE
“THE AGENCY’s” “Website” must be used only to make or purchase legitimate reservations and the “User” may not use it for any other purpose, including, but without limitation, making any speculative, false, or fraudulent reservation.
The “Website” and its content, such as, illustratively but not limited to, texts, paragraphs, statements, specific combinations of words, letters or phonetic elements, graphics, icons, brands, logos, graphic design works, photographs, commercial advertisements, commercial method, specific combination of colors and shapes, editorial material, printed formats, search formats, digital downloads, data compilations, source codes, software, etc., are the exclusive property of ANDESCAPE PERU S.A.C. or they have all the Licenses and Authorizations for such use; therefore they may not be copied, reproduced, republished, uploaded, modified, transmitted, or distributed without having the prior, express, and written authorization of ANDESCAPE PERU S.A.C., except in cases where you download to view and print the material contained on the “Website” or download or print the material sent to your email address by ANDESCAPE PERU S.A.C., in both situations, you may use it solely and exclusively for personal use, with any total or partial reproduction of the “Website” content or any use of its content intended for commercial profit being strictly prohibited. Unauthorized use of this website or any total or partial reproduction of the “Website” and/or content and its material may violate the laws governing intellectual property and other Peruvian regulations. Keep in mind that each “Provider” has its own regulations for the provision of its Tourist Services. When reviewing the regulations, without prejudice to other matters of interest to you, pay attention to the following points:
We provide you with the following terms and conditions that regulate the use of the “Website” as a preliminary step to manage the acquisition of a tourist service, so it is of utmost importance that they are carefully read before contracting and/or proceeding with the purchase.
We reserve the right to make the necessary changes to our “Website” (https://www.andescapeperu.com) at any time.
We inform you that we may use your personal information and data in accordance with our Privacy and Cookies Notice, which are incorporated herein by reference. You hereby accept the terms of our Privacy and Cookies Notice, including the obligations contained in said notices.
RESERVATION, PAYMENT AND CANCELLATION POLICY
To make the reservation we will require requesting the passenger’s information to prepare the passenger’s reservation file.
To make your reservation we require that you send us the following information:
- Requested Service
- Departure Date
- Full Names
- Passport Number
- Date of Birth
- Nationality
- Arrival Flight Date and Time
- Passport Validity Date
- Extra requirements
- Dietary restrictions and/or others.
Additionally, we require that:
- Make an advance payment of 50% (non-refundable amount that will cover the basic expenses of the service).
- Full payment is required 45 days prior to arrival.
- All flights must be paid in full at the time of booking. They are generally non-refundable.
NOTE: Certain luxury suppliers require full payment up to 100 days in advance, which may mean your non-refundable deposit is greater than 20%. We will inform you at the time of booking if this is the case.
Payment can be made according to the following modalities:
- By making a deposit into our bank account, which we will send to you upon receiving your complete information.
- Via Online Payment through our website https://www.andescapeperu.com, according to the instructions of the operations area. Please verify the reservation, payment, and cancellation policies on our website, Online Payment zone. Shipping and transfer costs will be paid by the passenger.
Cancellation Policy
Full payment is required six weeks prior to trip departure. If you cancel the trip, we reserve the right to charge:
- A non-refundable deposit of 20%.
- The total cost of flights purchased on your behalf.
- All non-refundable services that have already been paid on your behalf. Including the $250 to cover the cost of the client’s and porters’ Inca Trail permits purchased on behalf of the client.
- From 45 to 35 days before departure, we charge 50% of the trip price.
- From 34 days or less, we charge 100% of the trip price.
While in Peru, in case of cancellation of any part of the trip, we will do everything possible to transfer the funds to alternative arrangements. If this is not possible, clients are expected to pay for any additional expenses incurred as they occur. Full receipts will be provided for your travel insurance claim.
- All cancellations must be received in writing.
- If you cancel your trip, first check your insurance policy. We will be happy to provide you with any supporting documentation you may need.
NOTE: Rates are based on the number of people in your group and no partial refunds will be given for unused travel arrangements.
Changing Your Reservation
An administrative fee of US$125 per passenger plus any additional costs will be charged in the event that a confirmed reservation is changed or transferred prior to 45 days before departure (departure being the arrival day of the booked tour). Within 45 to 15 days of departure, a fee of US$200 per passenger plus any additional costs will be charged, and within 14 days of departure, a fee of US$300 per passenger plus any additional costs will be charged.
Please note that domestic/internal flights cannot be changed, are non-refundable and non-transferable, and any changes to airline tickets once the tour has been paid in full are at the client’s expense. Also note that while the Company will make every effort to obtain the same accommodation, tour changes may result in accommodation changes. If a passenger leaves the tour prior to its completion, ANDESCAPE PERU S.A.C. shall cease to have any responsibility to or for them.
If you wish to change a trip, we will do everything possible to change the dates at a minimal cost to you.
Changes to Your Tour
While ANDESCAPE PERU S.A.C. will make every effort to operate all tours as advertised, reasonable changes to the itinerary may be made when the Company deems it necessary or advisable. In cases of force majeure, it is the client’s responsibility to pay for any changes necessary to complete the tour and/or transport the client to their international departure flight. In cases of force majeure, we reserve the right to change any of the facilities, services, prices, or itineraries described in the brochure, website, or invoice/receipt provided to the client. If we are aware of a major change, the client will be informed at the time of booking.
Force majeure may include, among other things: war, threat of war, riots, civil strife, industrial disputes, decisions by governments or governmental authorities, terrorist activities or the threat thereof, strikes, epidemics, pandemics, illness, physical injury, quarantine, medical, customs or immigration regulations, natural or nuclear disasters, fires, or adverse weather conditions, technical or maintenance problems with transportation, changes imposed by the rescheduling or cancellation of flights by an airline or other similar events beyond our control.
If ANDESCAPE PERU S.A.C. and/or any of its suppliers are affected by an event of force majeure, they shall be entitled to, and may, at their sole discretion, vary or cancel any itinerary or arrangement in connection with the tour.
NOTES: Permits and entrance fees for the Inca Trail to Machu Picchu, Huayna Picchu, Machu Picchu mountain, or Huchuy Picchu must be purchased with the full name, date of birth, nationality, and passport number that will be presented to the entrance guard. You will not be allowed to enter if there is any discrepancy.
Up to 45 days beforehand we can change permits to reflect the new passport number, but we need full evidence of a non-fraudulent change.
Permits and entrance fees for the Inca Trail to Machu Picchu, Huayna Picchu, Machu Picchu mountain, or Huchuy Picchu, once purchased on your behalf, are 100% non-refundable unless Machu Picchu or the Inca Trail are closed on the particular day you are due to travel. If the Inca Trail and Machu Picchu are closed on your travel date, the Peruvian government currently allows us to apply, on your behalf, for a refund for the unused permit or entrance fee. This refund can only be processed on the travel date or shortly after and may take several weeks or months to process.
Expired passports: we need scans of the old and new passport. The new issue date must be close to or after the purchase of the permit; otherwise, they will ask why it was not obtained beforehand.
Name change: scans of old and new passports and marriage certificate / public deed certificate.
Lost passport: scans of the old and new passports and police report.
If no passport exists, permits can be purchased with any photographic identity document (driver’s license, ID card, etc.), but again, both must be scanned and a permit change request must be submitted.
We also advise clients to travel with their old passports in case there is a problem.
EMERGENCY CHANGES: 45 days before an Inca Trail (15 days for a km104) the permit is “frozen” and any late change is considered an emergency change. We have to request the authorities to accept the change, which they can refuse. If approved, we will be charged a $100 re-issuance fee per permit. We will pass this $100 fee on to the clients.
Accommodation: We cannot guarantee that a king-size bed room will always be available, in which case we will book a twin/double room. In the case of a fixed departure, single clients will automatically be assigned a single room and charged a single supplement. Please indicate if you are willing to share a double room and we will try to match you up to reduce the single supplement.
Client safety and responsibility: Clients traveling with ANDESCAPE PERU S.A.C. are expected to comply with certain basic safety rules, including:
- Inform the guide about any medical condition or any other factor that may affect your safety or that of any other person.
- Respect the guide’s decisions.
- Be responsible for and take care of the individual equipment assigned to them.
- Keep covered to avoid sun exposure and insect bites.
- Drink plenty of water to avoid heatstroke and dehydration.
- Understand that national parks are being entered and that there are certain rules regarding garbage, restricted areas, waste, and wildlife that must be respected.
- Be honest with yourself regarding how comfortable you feel and whether you are testing your limits.
- Seat belts are a legal requirement on all modes of transportation in Peru. Clients must ensure they use them or inform the guide if they do not work.
- Advise your guide if any medical emergency arises that, if left untreated, could endanger the safety of the entire group.
RISK
It is essential that you understand that some of our trips entail “risks” inherent to the activity. For example, it is impossible to go mountain biking or rafting without an element of risk. Read our risk and safety section here to ensure you are aware of the true nature of the trip and how we can work together to minimize any risk.
Declaration of participation: By booking this trip, I understand that the activities we are booking carry inherent risks and risk of accident and/or injury. We also understand that we are entitled to ask questions about the nature of these risks.
INSURANCE
Please note that ANDESCAPE PERU S.A.C. strongly recommends that you and your group take out comprehensive medical and travel insurance when traveling to Latin America. Check that it covers altitudes up to 4300m. The minimum required is medical and personal accident. Peruvian hospitals require proof of ability to pay before admitting you.
- Medical and Trip Cancellation Insurance
ANDESCAPE PERU S.A.C. strongly recommends that you and your group take out comprehensive medical and trip cancellation insurance to cover you during your trip to South America.
Medical insurance covering illness, personal accidents, emergency evacuation, and repatriation expenses is not included in any ANDESCAPE PERU S.A.C. tour. You must purchase insurance covering all dates of your trip, from the moment of arrival in the country until the moment of departure. Without this, you are responsible for your own personal medical expenses and agree that you are responsible for and will purchase travel medical insurance to cover you while abroad during your ANDESCAPE PERU S.A.C. adventure, or you agree to pay medical expenses directly.
Depending on the tour you have purchased, check that the policy covers you for high-altitude travel and for activities such as trekking, hiking, mountain biking, electric biking, rafting, kayaking, paddleboarding, etc., where applicable.
We also strongly recommend that you take out travel insurance that covers you for other incidents, such as trip cancellation before departure, missed flights, lost belongings, lost passports, delayed flights, failure to meet the scheduled itinerary due to illness or other issues such as force majeure, etc. Although this coverage is optional, it is highly recommended. See below for our cancellation policy. Any additional services required due to any of the above situations must be paid locally at the time they occur, so ensure that, if you do not take out travel insurance, you have the means to pay for these expenses in the country.
Please note that we will always try to be as flexible as possible so that we can all have a satisfactory outcome to any problem that may arise during your trip with us, and we will work very hard to exchange services, whenever possible, at minimal or no cost. However, sometimes this is impossible and all we can do is provide a receipt for your insurance company, which is why, in our opinion, having medical and travel insurance is an essential part of any trip, even if only for your own peace of mind.
OTHERS:
- In Peru, tourists (staying less than sixty days) are exempt from the 18% sales tax in hotels. In all hotels, you must present your passport at the hotel reception to prove that you are a tourist. If you cannot do so, you will be charged an additional 18% per hotel night.
- Peruvian hotels are not very flexible and have strict “72-hour” “no-show” policies. If you do not honor your reservation, they will not refund your money or transfer the reservation to another night. However, they will charge you the additional 18% IGV (sales tax) for not proving that you are a tourist.
- Obtaining suitable domestic and international flights is the client’s responsibility.
- Airlines operating in Peru regularly overbook and use any excuse to bump people from their flights. Airlines in Peru are also not very flexible. If they are kind enough to transfer your airline ticket, they will charge you a reissue fee and any increase in the fare.
- Airport transfer times have been calculated based on flight times provided at the time of booking. We highly recommend checking in online the night before the flight and double-checking that the times are still correct with your guide.
- Peruvian immigration authorities require a passport valid for at least six months upon entering Peru.
- If traveling with children and you are a single parent or grandparent, it is worth having a letter from the other parent expressing “permission” to cross the border and receive medical treatment. A copy of the birth certificate will also resolve any surname differences. This is not currently a requirement for non-Peruvian residents, but it can save you some very unpleasant conversations with the authorities.
- Obtaining the correct vaccinations and visas to visit Peru is the client’s responsibility. Airlines making stopovers in Brazil or Costa Rica may require a yellow fever vaccination.
- Lost luggage issues are between the airline and the client. While we will do our best to assist you with recovery, new purchases, or reuniting you with your luggage, clients should be aware that this is out of our control.
- Medical and Trip Cancellation Insurance. ANDESCAPE PERU S.A.C. strongly recommends that you and your group take out comprehensive medical and trip cancellation insurance to cover you during your trip to South America. Check that the policy covers you at altitudes up to 4300m, if applicable.
- We try to be as flexible as possible so that we can all have a satisfactory outcome to any problem.
- We work very hard to exchange services free of charge, but sometimes it is impossible and all we can do is provide a receipt for your insurance company.
